Terms & Conditions

1. Parties
This agreement is between:

• Surfupp Yazılım Bilişim ve Teknoloji Limited Şirketi
  Gülbahçe Caddesi, İzmir Yüksek Teknoloji Enstitüsü, Kuluçka Merkezi, 1/45

• Commercial enterprises and individual legal entities (“Business”) using the Surfupp platform.
   

2. Subject of the Terms
These Terms govern the Business’s access to the Surfupp platform and the use of:

• Management Application

• Private Online Customer Portal
   

3. Platform and Services
Surfupp provides the following services to the Business:

• Reservation management and customer registration

• Payment and invoicing infrastructure

• Staff payroll and payment tracking

• Analytical reporting and performance monitoring

Business obligations:

• Use the platform solely for legal and commercial purposes.

• Surfupp ensures platform availability and security but is not responsible for technical interruptions or content issues.
   

4. Fees and Payment
Platform Access Fee:

• Annual fee determined in the agreement between Surfupp and the Business.

• Can be paid in 1 or 2 installments.

Customer Payments (End-User Payments):

• Collected either via Surfupp through PayTR or integrated into the Business’s own payment interface.

• Transaction fees or commission rates are agreed separately.
   

5. Customer Data Ownership and Use

• Customer data belongs to the Business.

• Surfupp may process this data for:

  • Platform operation

  • Payment processing

  • Reporting and analytics

• With customer consent, Surfupp may use the data in the future marketplace platform.

• Data is only shared with third parties when legally required.
   

6. Business Obligations

• Responsible for the content, quality, and customer satisfaction of services.

• Must comply with platform rules and applicable laws.

• Surfupp may restrict access or terminate the agreement for violations.
   

7. Termination

• Either party may terminate the agreement with 30 days written notice.

• Surfupp may unilaterally terminate the agreement if the Business breaches the Terms.
   

8. Governing Law and Jurisdiction

• Governed by the laws of the Republic of Turkey.

• Disputes are subject to Istanbul Courts and Enforcement Offices.
   

9. Website Disclaimer

• These Terms are for informational purposes only.

• The binding agreement is the one executed between Surfupp and the Business.
   

10. Non-Disclosure & Non-Compete

• Keep all technical, commercial, and operational information confidential.

• Do not copy, reproduce, or transfer platform, software, content, or customer data without Surfupp’s written consent.

• Do not target Surfupp’s customers or replicate its business model.

• Obligation remains 2 years after termination.
